4mytutors Terms and Conditions

1.      Introduction

These Terms govern the access to and use of the 4mytutors website marketplace, including accounts, bookings, tutoring services arranged through the platform, payments, cancellations and conduct. By accessing, browsing, registering for or using 4mytutors, you agree to comply with these Terms of Use, our Privacy Notice, Safeguarding Policy and any other policies published on the platform. If a parent, carer, school or other organisation arranges tuition for a learner, that person or organisation is responsible for accepting these Terms and ensuring that the learner follows all relevant platform and safeguarding requirements.

2.      About 4mytutors

4mytutors is a trading division of 4myschools Ltd and operates as an online marketplace that connects parents, carers, learners, schools and other clients with independent tutors.

4mytutors does not employ tutors, provide tutoring services directly or supervise lessons delivered by tutors. Tutors are independent service providers and are solely responsible for the services they provide.

3.      Eligibility, Accounts and Information

Users must provide complete, accurate and current information and promptly update any material change. Account credentials must be kept confidential. Users are responsible for activity carried out through their account unless they notify 4mytutors promptly of suspected unauthorised access. A learner under 18 must use the service under the authority and oversight of a parent, carer, school or other responsible adult. Accounts and bookings for children must be managed in accordance with the platform’s age and safeguarding arrangements. 4mytutors may refuse registration, request further information or suspend access where reasonably necessary for safety, verification, legal compliance or platform integrity.

4.      Tutor Vetting and Tutor Responsibilities

Before being listed on the platform, tutors may be required to provide documentation and information to support identity, qualification, safeguarding and suitability checks.

Whilst 4mytutors undertakes reasonable vetting procedures, users remain responsible for determining whether a tutor is suitable for their individual requirements. We do not guarantee educational outcomes, examination results or student performance.

Tutors using the platform agree to:

  • Maintain accurate profile information.
  • Hold any qualifications, experience and insurance they claim to possess.
  • Comply with safeguarding and child protection requirements.
  • Notify 4mytutors of any change that may affect their suitability to work with children or young people.
  • Deliver services professionally and lawfully.

4mytutors may suspend or remove tutor profiles where standards, policies or safeguarding requirements are not met.

Tutors are responsible for their own business records, income tax, National Insurance contributions, VAT where applicable and all other tax, registration, reporting, regulatory and business obligations. 4mytutors will not make employment-related deductions or payments except where legally required.

5.      Client and Learner Responsibilities

Clients and learners must:

  • Provide accurate booking and learner information.
  • Decide whether a tutor and service are suitable for their needs.
  • Behave respectfully and lawfully.
  • Provide an appropriate, safe and private environment for sessions.
  • Ensure appropriate adult oversight and safeguarding arrangements for children.
  • Not misuse session content, tutor materials or personal information.

Clients should review a tutor’s profile and ask any reasonable questions needed before booking. Vetting by 4mytutors does not remove the client’s responsibility to make an informed suitability decision.

6.      Bookings and Tutoring Services

Clients may book tutoring services through the platform. The booked tutoring service is provided by the tutor, not by 4mytutors. Bookings are generally confirmed using the tutor’s stated availability. The client and tutor will receive confirmation through the platform and/or by email. Users must check the booking details are correct and report errors promptly.

Tutors and clients must use the video-call facility required by 4mytutors unless otherwise agreed. Each party is responsible for a suitable device, reliable internet connection and a private, safe and appropriate environment.

4mytutors does not routinely record session audio or video. No user may record, photograph, copy, stream or otherwise capture a session without the prior express agreement of everyone involved and unless the recording is lawful and consistent with safeguarding, confidentiality and data protection obligations. 

4mytutors may retain limited technical and booking information, such as the scheduled time, connection status, duration and attendance information, to operate the platform, resolve disputes, maintain security and support users, as explained in the Privacy Notice.

Clients are responsible for deciding whether a tutor and service are suitable. Tutors are responsible for deciding whether they have the competence, capacity and appropriate arrangements to provide the requested service. 4mytutors does not guarantee that a particular tutor will meet a learner’s individual needs or produce a particular educational outcome, examination result or improvement. 

7.      Prices, Payments and Tutor Fees

Tutors set the prices displayed for their services. The total price and any applicable charges will be shown before the client confirms a booking. Clients must pay through the 4mytutors platform using Stripe or another payment provider notified by 4mytutors. Users must provide accurate and valid payment details.

4mytutors currently deducts a commission of 20% from the amount paid for completed bookings before paying the balance to the tutor. 4mytutors does not currently charge clients a separate booking fee. If these charges change, the applicable charges will be communicated before they take effect and displayed as required.

Tutor payments are subject to completion of the booking, these Terms, dispute and refund handling, verification checks and the payment provider’s terms and processing arrangements. Nothing in these Terms limits any statutory right to challenge an unauthorised or incorrectly processed payment. 

8.      Booking Cancellation, Rescheduling, Refunds and No-Shows

A client may cancel or request to reschedule before the scheduled start time. Where cancelled before that time, 4mytutors will arrange a full refund or rescheduling, subject to payment-processing arrangements. A booking cannot normally be cancelled or rescheduled after its scheduled start time. A client who does not attend and did not cancel will be treated as a no-show. Unless a valid dispute is accepted, the tutor may be paid for the booking.

A tutor may cancel or request rescheduling before the scheduled start time and should give as much notice as reasonably possible. If the tutor cancels, the client will be offered a full refund or an opportunity to reschedule. If a tutor does not attend and the issue is confirmed, the client will receive a full refund or may choose to reschedule.

Affected users should raise a booking dispute as soon as reasonably possible. 4mytutors may review booking records, platform activity, communications and other relevant information. It may decline to investigate where an unreasonable delay means relevant information is no longer available. Decisions on booking disputes will be made reasonably and in good faith. This section does not affect statutory consumer rights.

9.      Consumer Cancellation Rights

If you are a consumer, you may have a legal right to change your mind within 14 days of entering into certain online contracts. These rights depend on the nature of the contract, when performance begins and whether the service has been fully performed.

Where you book a session or request platform services that are due to begin within the 14-day cancellation period, you expressly request that the relevant booking, payment, matching and tutoring services may begin immediately. If a service has been fully performed after your express request, you may lose the right to cancel that service. If performance has begun but is not complete, you may be required to pay a proportionate amount for services supplied before cancellation, where permitted by law.

Statutory cancellation rights are separate from the booking cancellation, rescheduling, refund and no-show rules in section 8. Nothing in these Terms removes rights that cannot lawfully be excluded or restricted. 

10.  Off-Platform Engagement

Users introduced through 4mytutors must not intentionally bypass the platform by arranging tutoring, payments or future engagements outside it where a commission or platform fee would otherwise be payable. Users must not use contact or other information obtained through 4mytutors to avoid applicable fees. Where 4mytutors reasonably believes that deliberate circumvention has occurred, it may suspend or terminate accounts and seek recovery of unpaid fees where permitted by law.

11.  Acceptable Use and Code of Conduct

All users of 4mytutors are expected to behave professionally, respectfully and lawfully. They must not:

  • Provide false, inaccurate or misleading information.
  • Misrepresent qualifications, experience, identity or safeguarding status.
  • Engage in abusive, threatening, discriminatory, harassing or unlawful behaviour.
  • Upload, share or publish offensive, defamatory, infringing or inappropriate content.
  • Attempt unauthorised access to systems, accounts or information.
  • Use the platform for unlawful or fraudulent purposes.
  • Breach safeguarding requirements or place any person at risk.

Tutors must maintain professional boundaries. Clients, learners and tutors must treat one another and platform staff with courtesy and respect.

12. Safeguarding

Safeguarding concerns take priority over the ordinary complaints process and will be handled under the 4mytutors Safeguarding Policy. 4mytutors may suspend accounts or bookings while safeguarding enquiries are undertaken. Where appropriate, concerns may be referred to children’s social care, the Local Authority Designated Officer (LADO), the police or another relevant body. Nothing in these Terms prevents any person from contacting emergency services or a safeguarding authority directly. In an emergency, call 999.

13. Complaints and Disputes

Complaints regarding the platform, tutors or services arranged through the platform should be submitted in accordance with the 4mytutors Complaints Policy. 4mytutors may seek information from the parties, review relevant platform records and take proportionate action, including guidance, warnings, refunds, restrictions, suspension or account removal. As tutors provide services independently, 4mytutors’ role in a complaint about tuition is to review platform standards, safeguarding and available evidence, and where appropriate, facilitate resolution. This does not make 4mytutors the provider of the tutoring service.

14. Intellectual Property, Content and Reviews

The platform, branding, software and materials supplied by 4mytutors are owned by or licensed to 4mytutors and may not be copied, adapted, distributed or exploited except as permitted by law or with written permission. Tutors retain ownership of their own teaching materials unless otherwise agreed. Clients and learners may use materials provided for their personal educational use only and must not reproduce, publish, sell or share them without permission.

A user who uploads profile information, reviews or other content confirms that it is lawful, accurate where stated as fact, and does not infringe another person’s rights. The user grants 4mytutors a non-exclusive licence to host, display and process that content as reasonably necessary to operate and promote the platform. 4mytutors may moderate or remove content that breaches these Terms, safeguarding requirements or the law. It does not guarantee that every review or user statement is accurate.

15. Privacy and Confidentiality

Personal information is handled in accordance with the 4mytutors Privacy Notice and applicable data protection law. Users must keep confidential any personal, educational, safeguarding or commercially sensitive information obtained through the platform, unless disclosure is authorised, necessary to provide the service, required for safeguarding, or required by law.

16. Availability and Changes to the Platform

4mytutors aims to keep the platform available but does not guarantee uninterrupted or error-free access. Access may be restricted for maintenance, security, legal, technical or operational reasons. 4mytutors may change platform features where reasonably necessary. Material changes affecting existing bookings or user rights will be communicated as appropriate.

17. Suspension and Termination

Users may stop using the platform at any time, subject to outstanding bookings, payments, disputes and obligations that are intended to continue. 4mytutors may warn, restrict, suspend or terminate an account where it reasonably believes there has been a breach of these Terms, a safeguarding or security risk, fraud, non-payment, deliberate fee avoidance or a legal or regulatory requirement.

Where appropriate, 4mytutors will explain the action taken. It may act immediately where necessary to protect a child, user, the public or the platform. Termination does not affect accrued rights, payment obligations or provisions intended to survive termination, including confidentiality, intellectual property and liability provisions. 

18. Liability

4mytutors acts as a marketplace connecting clients with independent tutors. It does not guarantee information supplied by users, continuous platform availability, the quality or suitability of tutoring, or any educational outcome. To the fullest extent permitted by law, 4mytutors is not responsible for loss arising solely from tutoring services delivered by an independent tutor or from a user’s failure to follow these Terms. Any limitation or exclusion applies only so far as it is lawful and reasonable.

Nothing in these Terms excludes or restricts liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, breach of rights that cannot lawfully be excluded, or any other liability that the law does not permit 4mytutors to exclude or restrict. Nothing in these Terms affects a consumer’s statutory rights.

19. Changes to These Terms

4mytutors may update these Terms and Conditions from time to time. The latest version will always be available on the website and continued use of the platform constitutes acceptance of any updated terms.

20. General Provisions

If any provision is found unlawful or unenforceable, the remaining provisions will continue in effect. A delay in enforcing a right does not waive that right. No person other than the user, 4myschools Ltd and, where relevant, the tutor or client party to a booking has a right to enforce these Terms, except where the law provides otherwise. These Terms,  together with the policies expressly incorporated into them and the confirmed details of each booking, form the agreement relevant to use of the platform. They do not exclude terms implied by law that cannot be excluded.

21. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. If you are a consumer resident elsewhere in the United Kingdom, you retain the benefit of any mandatory protections and rights to bring proceedings available under the law applicable to you. Otherwise, the courts of England and Wales will have jurisdiction.
